The Fillmore County Board of Supervisors convened in open and public session at 9:00 a.m., July 25, 2006, in the Courthouse Boardroom in Geneva, Nebraska with Chairman Mueller presiding.  Members present were Cerny, Kimbrough, Yates, Capek, Galusha, and Simacek.  The County Clerk was present to record the minutes of the meeting.

 

            Notice of meeting was given by publication and by broadcasting on radio station KAWL.  A copy of the affidavit of publication is on file in the County Clerk’s office.  All proceedings hereinafter shown were taken while the convened meeting was open to the public.  The meeting adjourned at 3:43 p.m.

 

MINUTES APPROVED

 

            Chairman of the Board, Mueller declared the minutes approved as presented.

 

DRIVEWAY PERMITS

 

            Simacek moved and Galusha seconded the motion to approve the following applications for a driveway permit:

 

            John Taylor – install a new 40’ driveway on the east side of the SE ¼ Section 17-7-2, Madison Township;

            Craig Reinsch – install a new 30’ to 40’ driveway on the south side of the SE ¼, Section 25-6-4, Momence Township;

            Shirley Lovegrove – install a new 40’ driveway on the south side of the SE ¼, Section 29-8-3, West Blue Township.

 

            Upon roll call, the vote was as follows:

 

Ayes: Mueller, Galusha, Capek, Yates, Simacek, Kimbrough, and Cerny

Nays: None

 

            The Chairman declared the motion carried.

 

ENGINEERING AGREEMENT FOR PROJECT #C-30(291)

 

            After discussion, Kimbrough moved and Yates seconded the motion to approve the engineering agreement with Speece Lewis in the amount of $5,100.00 for concrete box located between Sections 10 & 15-5-1, Franklin Township.  Upon roll call, the vote was as follows:

 

Ayes: Galusha, Capek, Yates, Simacek, Kimbrough, Cerny, and Mueller

Nays: None

 

            The Chairman declared the motion carried.

 

ENGINEERING AGREEMENT FOR PROJECT #C-30(243)

 

            After discussion, Capek moved and Simacek seconded the motion to approve the engineering agreement with Speece Lewis in the amount of $9,000.00 for a concrete box located between Section 31-6-1, Glengary Township and Section 36-6-2 Chelsea Township.  Upon roll call, the vote was as follows:

 

Ayes: Capek, Yates, Simacek, Kimbrough, Cerny, Mueller, and Galusha

Nays: None

 

            The Chairman declared the motion carried.

 

INTERLOCAL AGREEMENT WITH CITY OF GENEVA

FOR TAR KETTLE & CRACK ROUTER

 

            Yates moved and Cerny seconded the motion to approve and sign the interlocal agreement with the City of Geneva to share the Crack Router owned by Fillmore County and the Tar Kettle owned by the City of Geneva.  Upon roll call, the vote was as follows:

 

Ayes: Yates, Simacek, Kimbrough, Cerny, Mueller, Galusha, and Capek

Nays: None

 

            The Chairman declared the motion carried.

 

INFORMAL BUDGET REVIEW

 

            Cindy Carrigan, Clerk Magistrate presented the County Court’s budget for 2006-2007; final action will not be taken until the budget hearing in September.

 

VETERAN’S SERVICE BOARD

 

            Cerny moved and Kimbrough seconded the motion to reappoint Richard Kleinschmidt to the Veteran’s Service Board for a five year term beginning on July 1, 2006 and ending June 30, 2011.  Upon roll call, the vote was as follows:

 

Ayes: Simacek, Kimbrough, Cerny, Mueller, Galusha, Capek, and Yates

Nays: None

 

            The Chairman declared the motion carried.

 

LINCOLN AREA AGENCY ON AGING’S AREA WIDE ADVISORY COUNCIL

 

            June Pederson, Director of Lincoln Area Agency on Aging mailed a letter to the Board, requesting the reappointment of Elly Brauning for a three year term.

 

            Yates moved and Cerny seconded the motion to reappoint Elly Brauning to the Lincoln Area Agency on Aging’s Area Wide Advisory Council for a three year term beginning on July 1, 2006 and ending June 30, 2009.  Upon roll call, the vote was as follows:

 

Ayes: Kimbrough, Cerny, Mueller, Galusha, Capek, Yates, and Simacek

Nays: None

 

            The Chairman declared the motion carried.

 

NIRMA INSURANCE

 

            After discussion, Capek moved and Galusha seconded the motion to approve the insurance coverage from Nebraska Intergovernmental Risk Management Association (NIRMA) for property, crime coverage, liability, and worker’s compensation for a term on August 1, 2006 to August 1, 2007.  Upon roll call, the vote was as follows:

 

Ayes: Mueller, Galusha, Capek, Yates, Simacek, and Kimbrough

Nays: None                   Abstaining due to conflict of interest: Cerny

 

            The Chairman declared the motion carried.

 

BONDS

 

            Tyler Williams, from Edward Jones gave the Board an update on the open bonds that the County has for the Courthouse renovation and the road bond.

AGREEMENT FOR COMMUNICATIONS & EQUIPMENT PROJECT

 

            Terry Marshall, Emergency Manager presented a revised agreement with Platte Valley Communications of Hastings for the communications and equipment project #HLS3403.

 

            After discussion, Kimbrough moved and Capek seconded the motion to approve and sign the revised contract with Platte Valley Communications of Hastings in the amount of $277,477.20.  Upon roll call, the vote as as follows:

INFORMAL BUDGET REVIEW

 

            County Extension presented their budget for 2006-2007; final action will not be taken until the budget hearing in September.  Tim Engle, Barb Whitley, Jan Stoldorf and Teri Gemar were present.

 

VOLUNTEER PLANNING & MANAGEMENT

 

            Shannon Vogler, Emergency Response Manager with Public Health Solutions and Theresa Gomez, Regional Administrative Aide/Project Manager with Region V Systems presented to the Board what the Volunteer Project is and what benefits the County has received.  To keep this Volunteer project going, they will need between $2,500.00 and $3,000.00 from all five counties (Fillmore, Gage, Jefferson, Saline, and Thayer).  Action on the request will be taken during the budget process.

 

BOARD OF EQUALIZATION

 

            At the request of the County Assessor, the Fillmore County Board of Supervisor’s reconvened as the Fillmore County Board of Equalization at 2:05 p.m.

HEARING FOR EXEMPTION FROM MOTOR VEHICLE FEES

 

            The County Treasurer presented an application from the Geneva Cemetery Association for exemption from motor vehicle fees.

 

            Yates moved and Kimbrough seconded the motion to approve the application from the Geneva Cemetery Association for a 1967 Ford CB Truck.  Upon roll call, the vote was as follows:

 

Ayes: Cerny, Mueller, Galusha, Capek, Yates, Simacek, and Kimbrough

Nays: None

RETURN TO REGULAR SESSION

 

            Kimbrough moved and Yates seconded the motion to adjourn as Board of Equalization and return to regular session of the Fillmore County Board of Supervisors at 3:24 p.m.  Upon roll call, the vote was as follows:

COURT APPOINTED SPECIAL ADVOCATES (CASA)

 

            Nicole Avis, presented the 2006-2007 budget request for CASA.  The budget request for the County decreased to $7,163.00 or $902.00 less than the 2005-2006 budget.  Action on the request will be taken during the budget process later this summer.

 

GENERAL ASSISTANCE

 

            Reviewed the changes that County Attorney, Jill Cunningham requested.  County Clerk will make the changes for review at the next board meeting.

 

ADJOURNMENT

 

            Agenda items “Lighting for Hwy. 81 & Road G and Stop Sign at Road M & Road 18” were tabled until the August 8th Board meeting.  As there were no other items to come before the Board, the Chairman declared the meeting adjourned until 9:00 a.m. August 8, 2006.
