The Fillmore County Board of Supervisors convened in open and public session at 9:00 a.m., April 25, 2006, in the Courthouse Boardroom in Geneva, Nebraska with Chairman Mueller presiding.  Members present were Cerny, Kimbrough, Yates, Capek, Galusha, and Simacek.  The County Clerk was present to record the minutes of the meeting.

 

            Notice of meeting was given by publication and by broadcasting on radio station KAWL.  A copy of the affidavit of publication is on file in the County Clerk’s office.  All proceedings hereinafter shown were taken while the convened meeting was open to the public.  The meeting adjourned at 2:12 p.m.

            Eric Williams, Veteran’s Service Officer presented Lisa K. Carroll as the primary part-time driver and Charles H. Brabec and Lambert Hopkins as substitute drivers to the Board.

 

            Capek moved and Yates seconded the motion to approve the part-time drivers as presented.  Upon roll call, the vote was as follows:

CHILD SUPPORT ATTORNEY

 

            Amy Nelson, County Clerk reported to the Board that Stephen Kraviec’s office had informed us that their billing was being submitted $65.58 short for the last twenty-one months. 

 

            After discussion, Kimbrough moved and Cerny seconded the motion to allow Kraviec’s office to submit a bill for $590.22, which would be for the nine months of current budget year.  We will not be paying the remaining twelve months, due to the fact that they were from a previous budget year.  Upon roll call, the vote was as follows:

 

Ayes: Mueller, Galusha, Capek, Yates, Simacek, Kimbrough, and Cerny

Nays: None

 

            The Chairman declared the motion carried.

 

SIGN INVENTORY & MAINTENANCE POLICY

 

            Jerry Lukes, Assistant Highway Superintendent presented the “Sign Inventory and Maintenance Policy” written by Elmer Hessheimer, Highway Superintendent.

 

            After discussion, Cerny moved and Galusha seconded the motion to approve the “Sign Inventory and Maintenance Policy”.  The policy will be kept on file at the Road’s Department and in the County Clerk’s office.  Upon roll call, the vote was as follows:

 

Ayes: Galusha, Capek, Yates, Simacek, Kimbrough, Cerny, and Mueller

Nays: None

STATE OF NEBRASKA LETTER

 

            Kimbrough moved and Simacek seconded the motion to approve and sign the letter to the State of Nebraska regarding electricity cost for lighting at the intersection of Hwy. 81 and Road G.  Upon roll call, the vote was as follows:

 

Ayes: Capek, Simacek, Kimbrough, Cerny, Mueller, and Galusha

Nays: None                   Absent: Yates

EMERGENCY DECLARED TO ADD ITEM TO AGENDA

 

            At the request of Assistant Highway Superintendent Jerry Lukes, Kimbrough moved and Simacek seconded the motion to declare an emergency in order to add an item to the agenda, said item “Change Order #1”.  Upon roll call, the vote was as follows:

 

Ayes: Simacek, Kimbrough, Cerny, Mueller, Galusha, and Capek

Nays: None                   Absent: Yates

 

            The Chairman declared the motion carried.

 

CHANGE ORDER

 

            After discussion, Cerny moved and Capek seconded the motion to accept Change Order #1 reducing the original contract with LeGrande Excavating by $39,973.10 for Project #C-30(358).  Upon roll call, the vote was as follows:

 

Ayes: Simacek, Kimbrough, Cerny, Mueller, Galusha, and Capek

Nays: None                   Absent: Yates

BOARD OF EQUALIZATION

 

            At the request of the Fillmore County Clerk, Galusha moved and Capek seconded the motion to go into session as the Fillmore County Board of Equalization at 10:18 a.m.  Upon roll call, the vote was as follows:

 

Ayes: Kimbrough, Cerny, Mueller, Galusha, Capek, Yates, and Simacek

Nays: None

 

            The Chairman declared the motion carried.

 

TAX CORRECTIONS

           

Cerny moved and Capek seconded the motion to approve Tax Corrections #14-05 and #15-05 as presented by the County Assessor.  Upon roll call, the vote was as follows:

GENEVA VALUATION CHANGES

 

            Yates moved and Simacek seconded the motion to approve the list of valuation changes for Geneva that didn’t get completed prior to the Abstract deadline.  A complete list was ordered to be filed in the County Clerk’s office.  Upon roll call, the vote was as follows:

            Yates moved and Capek seconded the motion to adjourn as Board of Equalization and return to regular session of the Fillmore County Board of Supervisors at 10:30 a.m.  Upon roll call, the vote was as follows:

COUNTY BURIALS

 

            P. R. Farmer from Farmer & Son Funeral Homes and the Board reviewed the current county burials policy.  P. R. and the County Clerk will work on updating the policy and present it for approval at a future Board meeting.

 

OZENBAUGH SUBDIVISION

 

            Planning and Zoning Administrator, Gerald Slezak submitted the plat for the Ozenbaugh Subdivision, located in the NE ¼, Section 11-5-2, Belle Prairie Township.

 

            Yates moved and Capek seconded the motion to approve the plat of the Ozenbaugh Subdivision with the proper signatures as follows:

 

            A tract of land located in the Northwest Quarter (NE ¼) of Section 11, Township 5 North, Range 2 West of the Sixth P. M., Fillmore County, Nebraska, more particularly described as follows: Commencing at the Northeast corner said Northeast Quarter (NE ¼) thence S00’00’00”W (assumed bearing) along the east line said Northeast Quarter (NE ¼) a distance of 33.00 feet to the south line of Highway Number 74 and place of beginning; thence continuing S00’00’00”W along said east line a distance of 385.00 feet; thence S90’00’00”W perpendicular to the east line said Northeast Quarter (NE ¼) a distance of 675.35 feet; thence N00’00’00”E parallel with the east line said Northeast Quarter (NE ¼) a distance of 380.37 feet to the south line said Highway number 74; thence N89’36’27”E along said south line parallel with the north line said Northeast Quarter (NE ¼) a distance of 675.37 feet to the place of beginning containing 5.93 acres of which 0.29 acres contained in the east 33.00 feet thereof is presently being used as a public road, said tract hereinafter known as Ozenbaugh Subdivision.

            Planning and Zoning Administrator, Gerald Slezak submitted the plat for the Poch Subdivision, located in the NW ¼ of the SW 1/4, Section 7-6-1, Glengary Township.

 

            Capek moved and Kimbrough seconded the motion to approve the plat of the Poch Subdivision as follows:

 

            A tract of land comprising of part of Government Lot 2, in the NW ¼ of the SW ¼ of Section 7, Township 6 North, Range 1 West of the 6th P. M., Fillmore County, Nebraska, described as follows: beginning at the NW corner of said SW ¼, and assuming the west line of said SW ¼ to have a bearing of N00’03’04”E; thence N89’01’19”E, and on the north line of said Government Lot 2, 454.54 feet to a ¾” rebar w/cap; thence S00’03’04”W, and parallel with the west line of said SW ¼, 262.27 feet to a ¾” rebar w/cap; thence S61’17’18”W, 330.38 feet to a ¾” rebar w/cap; thence S89’01’17”W, 164.88 feet to a ¾” rebar w/cap on the west line of said SW ¼; thence N00’03’04”E, and on the west line of said SW ¼, 416.04 feet to the point of beginning and containing 3.83 acres more or less of which 0.32 of an acre more or less is occupied by county road R.O.W.

UP-DATE ON COMMUNICATIONS

 AND EMERGENCY MANAGEMENT GRANT

 

            Terry Marshall, Emergency Manager gave the Board an up-date on how the communications for the new tower were coming together and presented an application for the Nebraska Emergency Management Grant.

 

Yates moved and Galusha seconded the motion to approve and sign the Nebraska Emergency Management Sub-grant for $18,370.00 for salary reimbursement.  Upon roll call, the vote was as follows:

 

Ayes: Kimbrough, Cerny, Mueller, Galusha, Capek, Yates, and Simacek

Nays: None

 

            The Chairman declared the motion carried.

 

GENERAL ASSISTANCE

           

            County Clerk gave all Board members copies of current policies from four other counties to review and have a discussion on at the May 23rd Board meeting.

 

ADJOURNMENT

 

            Agenda items “Bonds for Ethanol Plant, and TERC board action” were tabled until the May 8th meeting.  As there were no other items to come before the Board, the Chairman declared the meeting adjourned until 9:00 a.m. May 8, 2006.
