The Fillmore County Board of Supervisors convened in open and public session at 9:00 a.m., April 11, 2006, in the Courthouse Boardroom in Geneva, Nebraska with Chairman Mueller presiding.  Members present were Cerny, Kimbrough, Yates, Capek, Galusha, and Simacek.  The County Clerk was present to record the minutes of the meeting.

 

            Notice of meeting was given by publication and by broadcasting on radio station KAWL.  A copy of the affidavit of publication is on file in the County Clerk’s office.  All proceedings hereinafter shown were taken while the convened meeting was open to the public.  The meeting adjourned at 2:30 p.m.

REPORT ON CHILLER

 

            Jason Naber, from Central Nebraska Refrigeration, Inc. informed the Board that the chiller is installed.  Carrier and Central Nebraska Refrigeration will start up the chiller on April 19th.  After discussion, the Board decided to have an Eddy test will be done prior to start up.

 

DRIVEWAY PERMITS

 

            Kimbrough moved and Galusha seconded the motion to approve the following driveway permit:

 

            Schelkopf Farms – install a new 40’ driveway on the west side of the S ½ of the NW ¼, Section 2-5-3, Hamilton Township.  Upon roll call, the vote was as follows:

 

Ayes: Yates, Simacek, Kimbrough, Cerny, Mueller, Galusha, and Capek

Nays: None

 

            The Chairman declared the motion carried.

 

NARROWING ROAD

 

            Highway Superintendent, Elmer Hessheimer informed the Board that County Road 7, between Highway 6 and Highway 41 is 38 feet wide and should only be 32 feet wide.

 

After discussion, Galusha moved and Yates seconded the motion to narrow up County Road 7, between Highway 6 and Highway 41 to 32 feet.  Upon roll call, the vote was as follows:

 

Ayes: Simacek, Kimbrough, Cerny, Mueller, Galusha, Capek, and Yates

Nays: None

 

            The Chairman declared the motion carried.

 

BOARD OF EQUALIZATION

 

            At the request of the Fillmore County Assessor, Capek moved and Simacek seconded the motion to go into session as the Fillmore County Board of Equalization at 10:35 a.m.  Upon roll call, the vote was as follows:

 

Ayes: Kimbrough, Cerny, Mueller, Galusha, Capek, Yates, and Simacek

Nays: None

 

            The Chairman declared the motion carried.

 

TAX CORRECTIONS

 

            After discussion, Cerny moved and Yates seconded the motion to approve Tax Corrections 12-05 and 13-05 as presented by the County Assessor.  Upon roll call, the vote was as follows:

 

Ayes: Cerny, Mueller, Galusha, Capek, Yates, Simacek, and Kimbrough

Nays: None

 

            The Chairman declared the motion carried.

 

RETURN TO REGULAR SESSION

 

            Yates moved and Kimbrough seconded the motion to adjourn as Board of Equalization and return to regular session of the Fillmore County Board of Supervisors at 10:47 a.m.  Upon roll call, the vote was as follows:

 

Ayes: Mueller, Galusha, Capek, Yates, Simacek, Kimbrough, and Cerny

Nays: None

 

            The Chairman declared the motion carried.

 

DEFICIT APPROPRIATION

 

            Kimbrough moved and Cerny seconded the introduction of the following resolution:

 

RESOLUTION 2006-16

 

            WHEREAS, all of the funds in the 2005-2006 budget for the Jail have been expended due to unforeseen circumstances, and

 

            WHEREAS, it is necessary to have county funds available in these budgets to meet all obligations for the 2005-2006 budget year,

 

            NOW THEREFORE, Be it Resolved by the Fillmore County Board of Supervisors that a need does exist for additional funds and that the sum of $20,000.00 be appropriated to the Jail budget from the unused funds in the Miscellaneous account of the General Fund Budget for 2005-2006 of said County.

 

            Upon roll call, the vote was as follows:

 

Ayes: Galusha, Capek, Yates, Simacek, Kimbrough, Cerny, and Mueller

Nays: None

 

            The Chairman declared the resolution adopted.

 

VEHICLE FOR SHERIFF

 

            Sheriff, Bill Burgess informed the Board that there was a 2005 Explorer on the MOCIC sale April 14th that he will be bidding on.

 

ENTERING AND LEAVING THE COURTHOUSE

 

            After discussion, the Board said that all employees leaving the building after 5:30 p.m. would not have to sign out, due to the time clocks.  If there is anyone entering the courthouse before 7:30 a.m. or after 5:30 p.m., they are be required to check-in with the Sheriff’s office.

 

ODEGEO CLASS

 

            Board approved two County employees to participate in the ODEGEO class this September.

 

RELEASING SECURITIES

 

            Simacek moved and Capek seconded the introduction of the following resolution:

 

RESOLUTION 2006-17

 

            RESOLVED, that the Geneva State Bank of Geneva, Nebraska, be allowed to withdraw the following security held by Federal Home Loan Bank of Topeka to-wit:

 

            Letter of Credit #6624 for $1,500,000.00

 

            Upon roll call, the vote was as follows:

 

Ayes: Capek, Yates, Simacek, Kimbrough, Cerny, Mueller, and Galusha

Nays: None

 

            The Chairman declared the resolution adopted.

 

BRYAN HOSPITAL

 

            Jerry Galusha, Board member reported that Region V informed him that Fillmore County should only pay the Medicaid rate.  The Board directed the County Clerk to submit a claim to Bryan Hospital at the Medicaid rate of $1,487.58 for the inmate bill of $4,798.65. 

 

FAIRMONT ANNEXATION

 

            Planning and Zoning Administrator, Gerald Slezak informed the Board that the Village of Fairmont will be annexing a tract of land in the NE ¼ and SE ¼, Section 36-8-3, West Blue Township.

 

            After discussion, Simacek moved and Yates seconded the motion to allow the Village of Fairmont to annex the following legal description:

 

            A tract of land in the northeast quarter and the southeast quarter of Section 36, Township 8 North, Range 3 West of the 6th P. M., Fillmore County, Nebraska more particularly described as follows: Commencing at the northwest corner of the northeast quarter of Section 36; thence north 89’59’48” east along the north line of the northeast quarter of Section 36 (bearing assumed and all of the following bearings referenced therefrom) distance 86.00 feet to the easterly R.O.W. line of Fillmore Western Railroad and the point of beginning; thence continuing north 89’59’48” east along the north line of the northeast quarter distance 150.00 feet; thence south 00’17’32” east parallel to the easterly railroad R.O.W. line distance 2257.65 feet; thence north 89’59’48” east parallel to the north line of the northeast quarter of said Section 36 distance 953.90 feet; thence south 00’06’32” west parallel to the west line of the northeast quarter and the southeast quarter of Section 36 distance 3030.42 feet to the south line of the southeast quarter of Section 36; thence north 89’58’18” west along the south line of the southeast quarter of Section 36 distance 1082.67 feet to the easterly R.O.W. line of Fillmore Western Railroad; thence north 00’17’32” west along the easterly R.O.W. line of Fillmore Western Railroad distance 5287.51 feet to the point of beginning.  Containing 83.83 acres more or less.

NIRMA’S BEST PRACTICES AND SAFETY MANUEL

 

            Jason Clancy, Loss Control Manager for NIRMA presented to the Board a model Safety Manual and ten (10) Best Practices.  Jason informed the Board that the Safety Committee should review the model Safety manual and request changes to fit Fillmore County.

 

FEE REPORTS

 

            Capek moved and Cerny seconded the motion to approve the following fee reports for March 2006:

 

County Clerk: March $7,567.72 (State $4,214.33 & County $3,353.39);

Quarterly $23,837.79 (State $13,240.54 & County $10,597.25)

Clerk of District Court: March $331.52; Quarterly $2,055.38

Sheriff: March $4,864.61; Quarterly $9,260.31

JAIL INSPECTION

 

            A jail inspection was completed, with everything looking in proper order.

 

ADJOURNMENT

 

            Agenda items “Lighting at Intersection of Hwy. 81 & Road G, Bonds for Ethanol Plant road, Approval of Geneva list, and Land Values for Ethanol Plant” were tabled until a future Board meeting.  As there were no other items to come before the Board, the Chairman declared the meeting adjourned until 9:00 a.m. on April 25, 2006.
