The Fillmore County Board of Supervisors convened in open and public session at 9:00 a.m., March 28, 2006, in the Courthouse Boardroom in Geneva, Nebraska with Chairman Mueller presiding.  Members present were Cerny, Kimbrough, Yates, Capek, Galusha, and Simacek.  The County Clerk was present to record the minutes of the meeting.

 

            Notice of meeting was given by publication and by broadcasting on radio station KAWL.  A copy of the affidavit of publication is on file in the County Clerk’s office.  All proceedings hereinafter shown were taken while the convened meeting was open to the public.  The meeting adjourned at 12:18 p.m.

VETERAN’S SERVICE OFFICE

 

            Veteran’s Service Officer, Eric Williams reported to the Board that he was unsuccessful in getting a volunteer to drive veterans to appointments about 2 days a week. 

 

            After discussion, the Board directed Eric to put an ad in the Signal for a part – time employee to assist him in driving veteran’s to appointments.

 

PUBLIC HEALTH BOARD

 

            Eric Williams informed the Board that Fillmore County needs to re-establish the Public Health Board in the near future.  The Public Health Board consists of the County Sheriff; County Attorney, County Board member, physician, and an at-large member.

 

DRIVEWAY PERMITS

 

            Kimbrough moved and Yates seconded the motion to approve the following driveway permits:

 

            John Dinneen – replace culvert in existing driveway on the east side of the NE ¼, Section 32-8-1, Exeter Township;

            Doug Johnson – to move existing driveway to the south on the west side of the SW ¼, Section 7-5-4, Bryant Township.  Upon roll call, the vote was as follows:

            Bids for the Fairmont southwest Concrete project were opened at 10:07 a.m.  The following bids were received:

FAIRMONT SOUTHWEST CONCRETE LETTING

 

            Larry Lewis from Speece Lewis Engineers reviewed all bids and recommended to the Board to go with lowest bidder Constructors, Inc. from Lincoln, Nebraska.

 

            After discussion, Galusha moved and Capek seconded the motion to accept the bid from Constructors, Inc. for $385,993.12 to pave County Road G.  Upon roll call, the vote was as follows:

 

Ayes: Galusha, Capek, Yates, Simacek, Kimbrough, and Mueller

Nays: None                   Abstaining due to conflict of interest: Cerny

 

            The Chairman declared the motion carried.

 

ROAD DEPT. FOUR DAY WORK WEEK

 

            After discussion, Kimbrough moved and Yates seconded the motion to approve the Road’s department to work a four day work week starting May 1, 2006 and ending September 1, 2006.  Upon roll call, the vote was as follows:

 

Ayes: Yates, Kimbrough, Cerny, and Mueller

Nays: Capek, Simacek, and Galusha

 

            The Chairman declared the motion carried.

 

KENO LICENSE

 

            Cerny moved and Simacek seconded the motion to approve the renewal of the keno license for 2006 - 2008.  Upon roll call, the vote was as follows:

Nays: None

BOARD OF EQUALIZATION

 

            At the request of the County Treasurer, Simacek moved and Capek seconded the motion to go into session as the Fillmore County Board of Equalization at 11:12 a.m.  Upon roll call, the vote was as follows:

 

Ayes: Simacek, Kimbrough, Cerny, Mueller, Galusha, Capek, and Yates
Nays: None

 

            The Chairman declared the motion carried.

 

HEARING FOR EXEMPTION FROM MOTOR VEHICLE FEES

 

            The County Treasurer presented an application from Sisters of Saint Francis for exemption from motor vehicle fees.

 

            Yates moved and Kimbrough seconded the motion to approve the application from Sisters of Saint Francis for exemption from motor vehicle fees on a 2006 Chrysler Sebring.  Upon roll call, the vote was as follows:

 

Ayes: Kimbrough, Cerny, Mueller, Galusha, Capek, Yates, and Simacek

Nays: None

 

            The Chairman declared the motion carried.

 

RETURN TO REGULAR SESSION

 

            Capek moved and Cerny seconded the motion to adjourn as Board of Equalization and return to regular session of the Fillmore County Board of Supervisors at 11:14 a.m.  Upon roll call, the vote was as follows:

 

Ayes: Cerny, Mueller, Galusha, Capek, Yates, Simacek, and Kimbrough

Nays: None

 

            The Chairman declared the motion carried.

 

PIERSON/FITCHETT LAW FIRM

 

            After discussion, Simacek moved and Galusha seconded the motion to approve and sign the contract with Pierson/Fitchett Law Firm for legal counsel regarding the chiller and renovation project.  Upon roll call, the vote was as follows:

 

Ayes: Mueller, Galusha, Capek, Yates, Simacek, Kimbrough, and Cerny

Nays: None

 

            The Chairman declared the motion carried.

 

BOARD OF EQUALIZATION

 

            County Assessor, Joan Ackland and Jerry Knoche from Knoche Appraisal asked the Board to set the dates to hear protests.  The following temporary dates were set: July 10th, July 18th, 19th, and 20th, starting at 9:00 a.m.

 

HALL’S SUBDIVISION

 

            Planning and Zoning Administrator, Gerald Slezak submitted the plat for Hall’s Subdivision, located in the SW ¼, Section 24-8-2, Fairmont Township.

 

            Cerny moved and Yates seconded the motion to approve the plat of Hall’s Subdivision as follows:

 

            A tract of land located in the SW ¼ of Section 24, T8N, R2W, of the 6th P. M., Fillmore County, Nebraska, described as follows: beginning at a point on the east line of said SW ¼ and the northerly R.O.W. line of U. S. Hwy. #6; thence N89’56’35”W (assumed bearing) on the northerly R. O. W. line of said U. S. Hwy. #6, 342.00 feet; thence N04’55’00”E, 269.00 feet; thence N48’52’26”E, 31.87 feet; thence N00’03’20”W, 464.00 feet to the southerly R. O. W. line of the Burlington Northern & Santa Fe Railroad; thence N85’40’27”E on said southerly R. O. ADJOURNMENT

 

            Agenda items “LB975 and General Assistance” were tabled until a future Board meeting.  As there were no other items to come before the Board, the Chairman declared the meeting adjourned until 9:00 a.m. on April 11, 2006.
