The Fillmore County Board of Supervisors convened in open and public session at 9:00 a.m., November 8, 2005, in the Courthouse Boardroom in Geneva, Nebraska with Chairman Kimbrough presiding. Members present were Cerny, Simacek, Yates, Capek, Galusha, and Mueller. The County Clerk was present to record the minutes of the meeting.

Notice of the meeting was given by publication and by broadcasting on radio station KAWL. A copy of the affidavit of publication is on file in the County Clerk’s Office. All proceedings hereinafter shown were taken while the convened meeting was open to the public. The meeting adjourned at 3:52 p.m.

MINUTES APPROVED WITH CORRECTION

Cerny moved and Yates seconded the motion to approve the minutes of the October 25, 2005 meeting, with the following correction: the 1997 Dodge Spirit listed as surplus should be a 1995 Dodge Spirit. Upon roll call, the vote was as follows:

Ayes: Galusha, Capek, Yates, Simacek, Kimbrough, Cerny, and Mueller

Nays: None

The Chairman declared the motion carried.

AIR CONDITIONING CONCERNS

Jason Naber with Central Nebraska Refrigeration, Inc. and Terry Volkmer, Custodian informed the Board that an Eddy Test had been performed on the chiller and the results of that test. Jerry Berggren, Architect and Ron Geary, Project Manager will be informed of the Eddy Test results.

DRIVEWAY PERMITS

Simacek moved and Mueller seconded the motion to approve the following driveway permits:

Betty Buzek and HP Farms – to install a new driveway on the half mile line on the west side of the W ½ of Section 1-6-1, Glengary Township.

Bill Cudaback – to install a new 30’ driveway on the south side of the SW ¼, Section 13-8-2, Fairmont Township.

Galen Kennel – to install a new 20’ – 25’ driveway on the north side of the NW ¼, Section 21-5-3, Hamilton Township.

Ralph Jansen – to install a new 30’ driveway on the south side of the SE ¼, Section 17-8-1, Exeter Township.

Tom Bumgarner – to widen existing driveway to 40’ and to move a drive to center of pivot on the south side of the SE ¼, Section 13-6-2, Chelsea Township.

Upon roll call, the vote was as follows:

Ayes: Capek, Yates, Simacek, Kimbrough, Cerny, Mueller, and Galusha

Nays: None

The Chairman declared the motion carried.

DITCH CLEANING PERMIT

Yates moved and Galusha seconded the motion to approve the following application for a permit to clean silt from a road ditch:

Henry Fehr Jr. – to clean silt from a ditch adjoining the east side of the NE ¼, Section 1-7-5, this adjoins Clay County.

Upon roll call, the vote was as follows:

Ayes: Yates, Simacek, Kimbrough, Mueller, Galusha, and Capek

Nays: None Absent: Cerny

The Chairman declared the motion carried.

LUBRICATING OIL

After discussion, Mueller moved and Cerny seconded the motion to award the lubricating oil letting to Grafton Oil, with the condition that their bid included providing the bulk storage containers, pumps, and any etc. items. Upon roll call, the vote was as follows:

Ayes: Simacek, Kimbrough, Cerny, Mueller, Galusha, Capek, and Yates

Nays: None

The Chairman declared the motion carried.

4–DOOR MINIVAN LETTING

Bids for the 4-door minivan were opened at 10:30 a.m. The following bids were received:

After discussion, the Board members decided they needed to go and look at a few of these minivans during lunch.

EDWARD JONES INVESTMENTS

After discussion, Mueller moved and Galusha seconded the motion to have Tyler Williams and Tom Sorenson with Edward Jones Investments handle the possible bond for the road project on the west ½ of Road G, between Road 12 and Highway 81. Upon roll call, the vote was as follows:

Ayes: Kimbrough, Mueller, Galusha, Capek, Yates, and Simacek

Nays: None Abstaining due to conflict of interest: Cerny

The Chairman declared the motion carried.

COLONIAL SUPPLEMENTAL INSURANCE

Kurt Genrich, with Colonial Supplemental Insurance informed the Board of the products Colonial offers as well as they are a benefits communication company, an enrollment company, and a supplemental insurance company.

4-DOOR MINIVAN

After discussion, Mueller moved and Galusha seconded the motion to buy the 2005 Dodge Grand Caravan from Erdkamp Motors with 10, 800 miles for $15,600.00. Upon roll call, the vote was as follows:

Ayes: Cerny, Mueller, Galusha, Capek, Yates, Simacek, and Kimbrough

Nays: None

The Chairman declared the motion carried.

EMPLOYEE RECOGNITION DINNER

Yates moved and Capek seconded the motion to approve the employee recognition dinner on January 13, 2007 at Evening with Friends in Milligan. Upon roll call, the vote was as follows:

Ayes: Mueller, Galusha, Capek, Yates, Simacek, Kimbrough, and Cerny

Nays: None

After discussion, Yates moved and Mueller seconded the motion to upgrade our current ArcView software and to purchase ArcEditor software for $5,000.00 for the Assessor’s office. Upon roll call, the vote was as follows:

NIRMA INTERLOCAL AGREEMENT

Simacek moved and Yates seconded the introduction of the following resolution:

RESOLUTION 2005-40

WHEREAS, Fillmore County has previously entered into Intergovernmental/Interlocal Agreements with other Nebraska Counties to form and participate in the Nebraska Intergovernmental Risk Management Association (NIRMA) and the Nebraska Intergovernmental Risk Management Association II (NIRMA II) as authorized by the Intergovernmental Risk Management Act (Neb. Rev. Stat. §44-4301 et seq); and

WHEREAS, Counties and other Public Agencies as defined in §44-4303 are allowed to participate in said cooperative undertakings; and

WHEREAS, NIRMA and NIRMA II provide risk management services such as loss prevention, safety audits, claims and litigation management, and coverage’s tailored to address liability exposures a county faces not economically available from other sources; and

WHEREAS, these coverage’s and risk management services are essential for the continued effective and efficient use of county taxpayer dollars; and

WHEREAS, the current Intergovernmental/Interlocal Agreements will expire on July 31, 2006, and

NOW, THEREFORE, BE IT RESOLVED, that Fillmore County Board hereby:

1. Extends its commitment to participate in NIRMA and NIRMA II for an additional three years covering the period August 1, 2006 through July 31, 2009; and

2. Declares that this Resolution shall serve as an amendment and addendum to the original Intergovernmental/Interlocal Agreements entered into by the County Board, said Intergovernmental/Interlocal Agreements readopted by and incorporated herein by this reference as amended.

ADJOURNMENT

Agenda items “Generator for 911 Tower, Sheriff’s Office Computer Issues, time clock & pay period changes and Handbook changes” were tabled until the November 22, 2005 meeting. As there were no other items to come before the Board, the Chairman declared the meeting adjourned until 9:00 a.m. November 22, 2005.
