Supervisors convened in open and public session at 9:00 a.m., September 13,
2005, in the Courthouse Boardroom in

Cerny moved and Simacek seconded the
motion to approve the minutes of the August 23rd regular meeting of
the Board. Upon roll call, the vote was

COURTHOUSE AIR
CONDITIONING
Terri Volkmer, Building and Grounds Supervisor
and Jason Naber from Central Nebraska Refrigeration, Inc. out of
DRIVEWAY PERMITS
Capek moved and Galusha seconded the
motion to approve the following applications for driveway permits:
Glen Kovanda – to widen existing
driveway to 40 ft. and install a new 20 ft. driveway to the east of the
existing driveway on the south side of the SW ¼ of Section 25-7-1, Liberty
Township;
Doris Miles – to replace existing
driveway on the west side of the NW ¼ of Section 5-7-2,
Irvin Sluka Estate – to widen
existing driveway to 30 – 35 ft. on the west side of the SW ¼ of Section
18-6-1,
LeRoy Rohr

SILT CLEANING PERMIT
Galusha moved and Mueller seconded
the motion to approve the following silt cleaning permit:

OCCUPY
Simacek moved and Yates seconded the
motion to approve the following permits to occupy county right-of-way:
Alltel
Communications – to bury communication cable between Sections 4 & 5-6-2,
Larry Roush – to bury water line,
electric line, and control line between the NW ¼ of Section 17-5-4 and the NE ¼
of Section 18-5-4, Bryant Township.
Larry Roush agrees to restore the public roads where they will be
working to the same condition as they were prior to their work, and will
accomplish such restoration to the reasonable satisfaction of the Fillmore
County Officials.
Jean Lovegrove – to bury gas line
between the SW ¼ of Section 4-7-3 and NW ¼ of Section 9-7-3, Geneva
Township. Jean Lovegrove agrees to
restore the public roads where they will be working to the same condition as they
were prior to their work, and will accomplish such restoration to the
reasonable satisfaction of the Fillmore County Officials.

REMOVING STOP SIGN
Mueller moved and Yates seconded the
introduction of the following resolution:
RESOLUTION 2005-26
In accordance with the standards set
forth in the Manual for Uniform Traffic Control Devices, as from time to time
amended, and
WHEREAS,
it is in the best interest of
The Fillmore County Highway
Department therefore requests formal approval to place, erect, remove, and
maintain traffic control devices on Fillmore County Roads at the following
locations:

Marcus Tooze with GIS Workshop addressed

CHILD SUPPORT
ENFORCEMENT SERVICES REIMBUSEMENT AGREEMENT

motion to approve and sign the Cooperative Reimbursement Agreement for Child
Support Enforcement Services. This
agreement is made and entered into by and between the State of Nebraska,
Nebraska Department of Health and Human Services including the Child Support
Enforcement Unit (CSEU) of said Department, and the

SALTZMAN FIRST
SUBDIVISION
Planning and Zoning Administrator,
Yates moved and Capek seconded the
motion to approve the plat of the Saltzman First Subdivision as follows:
A tract of land located in the
Northeast Quarter (NE ¼) Section 11, Township 5 North, Range 4 West of the
Sixth P.M., Fillmore County, Nebraska, more particularly described as follows:
Commencing at the Northeast Corner said Northeast Quarter (NE ¼) thence
S00’00’00”W (assumed bearing) along the east line said Northeast Quarter (NE ¼)
a distance of 80.00 feet to the south line of U.S. Highway Number 74 and Place
of Beginning; thence continuing S00’00’00”W along said east line a distance of
462.77 feet; thence S89’20’16”W along the north line of a tract of land
surveyed June 19, 1986, by Thomas Krueger, a distance of 300.00 feet; thence
N00’00’00”E parallel with the east line said Northeast Quarter (NE ¼) a
distance of 462.24 feet to the south line of said U.S. Highway Number 74;
thence N89’14’11”E along said south line a distance of 300.00 feet to the Place

FAIR BOARD
Fair Board members Debra Hoarty,
Dale Stengel, and Blaine Richards informed the Board that they are looking into
putting air conditioning in the Fillmore County Ag Hall building. The cost to do this is approximately
$60,000.00, which is funded from current funds available.
BUDGET HEARING
The hearing on the county’s budget
for 2004-2005 was opened at 1:30 p.m. as advertised. Alan Emshoff and Patt Lentfer representing
the Fillmore County Development Corporation informed the Board that they
appreciated the funds they have been given and appreciate any funds that they
are able to give this year.
SPECIAL HEARING TO SET
FINAL TAX REQUEST
The special hearing on setting the
final tax request at a different amount than the prior tax request opened at
1:31 p.m. No on appeared to testify at
the hearing.

BUDGET ADOPTED
Cerny moved and Mueller seconded the
introduction of the following resolution:
RESOLUTION 2005-29
WHEREAS,
a proposed
NOW,
THEREFORE, BE IT RESOLVED by the Board of Supervisors of Fillmore County,
Nebraska as follows:
Section 1: That the amended budget
for the Fiscal Year July 1, 2005 to June 30, 2006, as evidenced by the Budget
Document be, and the same hereby is, adopted as the
budget for
Section 2: That the offices,
departments, activities, and institutions herein named are hereby authorized to
expend the amounts herein appropriated to them during the fiscal year beginning
July 1, 2005 and ending June 30, 2006.
Section 3: That the income necessary
to finance the appropriations made and expenditures authorized shall be
provided out of the unencumbered cash balance in each fund, revenues other than
taxation to be collected during the fiscal year in each fund, and tax levy
requirements for each fund.
