            The Fillmore County Board of Supervisors convened in open and public session at 9:00 a.m., September 13, 2005, in the Courthouse Boardroom in Geneva, Nebraska with Chairman Kimbrough presiding.  Members present were Cerny, Simacek, Yates, Capek, Galusha, and Mueller.  The County Clerk was present to record the minutes of the meeting.

 

            Notice of the meeting was given by publication and by broadcasting on radio station KAWL.  A copy of the affidavit of publication is on file in the County Clerk’s Office.  All proceedings hereinafter shown were taken while the convened meeting was open to the public.  The meeting adjourned at 2:46 p.m.

 

MINUTES

 

            Cerny moved and Simacek seconded the motion to approve the minutes of the August 23rd regular meeting of the Board.  Upon roll call, the vote was as follows:

FEE REPORTS

 

            Simacek moved and Capek seconded the motion to approve the following fee reports for August 2005:

 

County Clerk: $9,339.76                        Clerk of District Court: $497.36             Sheriff: $1,302.84

 

            Upon roll call, the vote was as follows:

 

Ayes: Yates, Simacek, Kimbrough, Cerny, Mueller, Galusha, and Capek

COURTHOUSE AIR CONDITIONING

 

            Terri Volkmer, Building and Grounds Supervisor and Jason Naber from Central Nebraska Refrigeration, Inc. out of York, NE informed the Board of the repairs that the air conditioning system would need to be operational.  The Board requested that Carrier come out and make sure that the system was installed correctly before the repairs are complete.  Once the repairs have been made, the chiller barrel will be sent to Carrier for them to explain what happened.  Jason will get an estimate for these repairs and report back to the Board.

 

DRIVEWAY PERMITS

 

            Capek moved and Galusha seconded the motion to approve the following applications for driveway permits:

 

            Glen Kovanda – to widen existing driveway to 40 ft. and install a new 20 ft. driveway to the east of the existing driveway on the south side of the SW ¼ of Section 25-7-1, Liberty Township;

            Doris Miles – to replace existing driveway on the west side of the NW ¼ of Section 5-7-2, Madison Township;

            Irvin Sluka Estate – to widen existing driveway to 30 – 35 ft. on the west side of the SW ¼ of Section 18-6-1, Glengary Township;

            LeRoy Rohr – to install a new 24 ft. driveway on the west side of the SW ¼ of Section 33-6-1, Glengary Township;

            Clair Christiancy – to widen existing driveway to 20 - 24 ft. on the south side of the SE ¼ of Section 18-6-1, Glengary Township.

 

            Upon roll call, the vote was as follows:

SILT CLEANING PERMIT

 

            Galusha moved and Mueller seconded the motion to approve the following silt cleaning permit:

 

            Clair Christiancy – to clean silt from road ditch located on the south of the SE ¼ of Section 18-6-1, Glengary Township.

 

            Upon roll call, the vote was as follows:

 

Ayes: Kimbrough, Cerny, Mueller, Galusha, Capek, Yates, and Simacek

Nays: None

OCCUPY COUNTY RIGHT-OF-WAY

 

            Simacek moved and Yates seconded the motion to approve the following permits to occupy county right-of-way:

 

            Alltel Communications – to bury communication cable between Sections 4 & 5-6-2, Chelsea Township.  Alltel agrees to restore the public roads where they will be working to the same condition as they were prior to their work, and will accomplish such restoration to the reasonable satisfaction of the Fillmore County Officials.

 

            Larry Roush – to bury water line, electric line, and control line between the NW ¼ of Section 17-5-4 and the NE ¼ of Section 18-5-4, Bryant Township.  Larry Roush agrees to restore the public roads where they will be working to the same condition as they were prior to their work, and will accomplish such restoration to the reasonable satisfaction of the Fillmore County Officials.

 

            Jean Lovegrove – to bury gas line between the SW ¼ of Section 4-7-3 and NW ¼ of Section 9-7-3, Geneva Township.  Jean Lovegrove agrees to restore the public roads where they will be working to the same condition as they were prior to their work, and will accomplish such restoration to the reasonable satisfaction of the Fillmore County Officials.

 

            Upon roll call, the vote was as follows:

LUBRICATING OIL LETTING

 

            After discussion, the Board set October 25th at 10:00 a.m. for the lubricating oil letting.

 

REMOVING STOP SIGN

 

            Mueller moved and Yates seconded the introduction of the following resolution:

 

RESOLUTION 2005-26

 

            In accordance with the standards set forth in the Manual for Uniform Traffic Control Devices, as from time to time amended, and

 

            WHEREAS, it is in the best interest of Fillmore County, Nebraska, to establish and maintain proper consistent highway signing in conformity with said manual,

 

            The Fillmore County Highway Department therefore requests formal approval to place, erect, remove, and maintain traffic control devices on Fillmore County Roads at the following locations:

                        Remove STOP sign                              on the north side of the intersection of County Road L

                                                                                    and County Road 23.

 

            NOW THEREFORE Be It Resolved by the Fillmore County Board of Supervisors that this request is approved this 13th day of September 2005.

GIS

 

            Marcus Tooze with GIS Workshop addressed the few questions that the County Attorney had with the contract.  Marcus agreed to make a few changes and have a new contract for the Board at the next meeting.

 

CHILD SUPPORT ENFORCEMENT SERVICES REIMBUSEMENT AGREEMENT

 

            Yates moved and Capek seconded the motion to approve and sign the Cooperative Reimbursement Agreement for Child Support Enforcement Services.  This agreement is made and entered into by and between the State of Nebraska, Nebraska Department of Health and Human Services including the Child Support Enforcement Unit (CSEU) of said Department, and the County Board of Supervisors and the County Attorney or Authorized Attorneys of Fillmore County, Nebraska.  This agreement commences on October 1, 2005 and terminates, unless the date is amended, on September 30, 2008.  Upon roll call, the vote was as follows:

RESCIND RESOLUTION 2004-17

 

            Simacek moved and Cerny seconded the motion to rescind resolution 2004-17 due to the fact that it was an Interlocal Cooperative Agreement to join Southeast Nebraska Development District.  Upon roll call, the vote was as follows:

JOIN SOUTHEAST NEBRASKA DEVELOPMENT DISTRICT

 

            Mueller moved and Galusha seconded the introduction of the following resolution:

 

RESOLUTION 2005-27

 

            A Resolution by the County of Fillmore, Nebraska, providing for full participation by the County in the Southeast Nebraska Development District, a Development District organized under the Interlocal Cooperative Act, Sections 13-801 through 13-827, Nebraska Revised Statutes (Reissue 1997 and Supp. 2002), of the State of Nebraska and under authority of Sections 13-901 to 13-1907, Nebraska Revised Statutes (Reissue 1997) (the Nebraska Development District Act).

 

            Be it resolved by the County Board of Supervisors that the County of Fillmore, Nebraska hereby declares its intent to join with the incorporated villages, cities or counties that are eligible and may wish to participate as a member of the Southeast Nebraska Development District through execution of an intergovernmental agreement.

 

            Be it further resolved that the Chairman of the County Board of Supervisors of Fillmore County is hereby authorized, on behalf of the County, to execute said agreement allowing for participation by Fillmore County in the Southeast Nebraska Development District, which said agreement shall be substantially in the words and figures set forth in that certain agreement, a copy of which is attached hereto and made a part hereof.

 

            THIS RESOLUTION APPROVED by the County Board of Supervisors of Fillmore County, Nebraska on this 13th day of September 2005.

FIRE DISTRICT SECRETARY/TREASURER’S BOND

 

            Yates moved and Cerny seconded the motion to approve the Bond for Robert Ackland as Secretary/Treasurer of the Geneva Rural Fire Protection District for $5,000.00 for his appointment, with an expiration date of Sept. 17, 2006.  Upon roll call, the vote was as follows:

SALTZMAN FIRST SUBDIVISION

 

            Planning and Zoning Administrator, Gerald Slezak submitted the plat for the Saltzman First Subdivision, located in the NE ¼ of Section 11-5-4, Bryant Township.  Gerald informed the Board that the Village of Shickley approved this subdivision on September 7, 2005.

 

            Yates moved and Capek seconded the motion to approve the plat of the Saltzman First Subdivision as follows:

 

            A tract of land located in the Northeast Quarter (NE ¼) Section 11, Township 5 North, Range 4 West of the Sixth P.M., Fillmore County, Nebraska, more particularly described as follows: Commencing at the Northeast Corner said Northeast Quarter (NE ¼) thence S00’00’00”W (assumed bearing) along the east line said Northeast Quarter (NE ¼) a distance of 80.00 feet to the south line of U.S. Highway Number 74 and Place of Beginning; thence continuing S00’00’00”W along said east line a distance of 462.77 feet; thence S89’20’16”W along the north line of a tract of land surveyed June 19, 1986, by Thomas Krueger, a distance of 300.00 feet; thence N00’00’00”E parallel with the east line said Northeast Quarter (NE ¼) a distance of 462.24 feet to the south line of said U.S. Highway Number 74; thence N89’14’11”E along said south line a distance of 300.00 feet to the Place of Beginning containing 3.19 acres of which 0.35 acres contained in the east 33.00 feet thereof is presently being used as a public road.

FAIR BOARD

 

            Fair Board members Debra Hoarty, Dale Stengel, and Blaine Richards informed the Board that they are looking into putting air conditioning in the Fillmore County Ag Hall building.  The cost to do this is approximately $60,000.00, which is funded from current funds available.

 

BUDGET HEARING

 

            The hearing on the county’s budget for 2004-2005 was opened at 1:30 p.m. as advertised.  Alan Emshoff and Patt Lentfer representing the Fillmore County Development Corporation informed the Board that they appreciated the funds they have been given and appreciate any funds that they are able to give this year.

 

SPECIAL HEARING TO SET FINAL TAX REQUEST

 

            The special hearing on setting the final tax request at a different amount than the prior tax request opened at 1:31 p.m.  No on appeared to testify at the hearing.

 

BOARD OF EQUALIZATION

 

            At the request of the County Clerk, Cerny moved and Yates seconded the motion to go into session as the Fillmore County Board of Equalization at 1:57 p.m.  Upon roll call, the vote was as follows:

 

Ayes: Mueller, Galusha, Capek, Yates, Simacek, Kimbrough, and Cerny

Nays: None

 

            The Chairman declared the motion carried.

 

ADDITIONAL BUDGET AUTHORITY

 

            Capek moved and Galusha seconded the motion to authorize up to one per cent additional budget authority as allowed by statute.  Upon roll call, the vote was as follows:

RETURN TO REGULAR SESSION

BUDGET ADOPTED

 

            Cerny moved and Mueller seconded the introduction of the following resolution:

 

RESOLUTION 2005-29

 

            WHEREAS, a proposed County Budget for the Fiscal Year July 1, 2005 to June 30, 2006, prepared by the Budget Making Authority, was transmitted to the County Board on the 23rd day of August, 2005, and hearing on said budget was held on September 13, 2005 and the budget was adopted.

 

            NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Fillmore County, Nebraska as follows:

 

            Section 1: That the amended budget for the Fiscal Year July 1, 2005 to June 30, 2006, as evidenced by the Budget Document be, and the same hereby is, adopted as the budget for Fillmore County for said fiscal year.

 

            Section 2: That the offices, departments, activities, and institutions herein named are hereby authorized to expend the amounts herein appropriated to them during the fiscal year beginning July 1, 2005 and ending June 30, 2006.

 

            Section 3: That the income necessary to finance the appropriations made and expenditures authorized shall be provided out of the unencumbered cash balance in each fund, revenues other than taxation to be collected during the fiscal year in each fund, and tax levy requirements for each fund.

 

            Upon roll call, the vote was as follows:
