June 8, 2004

 

The Fillmore County Board of Supervisors convened in open and public session at 8.30 a.m. on June 8, 2004, in the Courthouse Boardroom in Geneva, Nebraska with Chairman Kimbrough presiding. Members present were Yates, Simacek, Galusha, Cerny, Mueller, and Capek. The County Clerk was present to record the minutes of the meeting. 

 

            Notice of the meeting was given by publication and by broadcasting on radio station KAWL.  A copy of the affidavit of publication is on file in the County Clerk’s Office.  All proceedings hereinafter shown were taken while the convened meeting was open to the public.  The meeting adjourned at 2.03 p.m.

 

MINUTES APPROVED WITH CORRECTION

 

            Yates moved and Cerny seconded the motion to approve the minutes of the May 25, 2004 meeting with the following correction:

           

            Correct the amount of the Homeland Security Grant to $498,600.

 

Upon roll call, the vote was as follows:

 

Ayes: Kimbrough, Mueller, Cerny, Simacek, Capek, Yates, and Galusha

Nays: None

 

            The Chairman declared the motion carried.

 

DISCUSSION

 

            Items discussed are as follows:

 

1. The storm damage report presented by Emergency Management Coordinator Terry Marshall.

2. Health insurance cost increases.

3. Mowing and removal of grass piles.

4.Truck parking in the two parking lots.

5. Estimate of $550 maximum on staining and resurface the exterior doors on the east, west and north entrances of the courthouse.

            6. Treasurer’s report showed all county funds with sufficient balances.

 

COURTHOUSE DOORS

 

            Galusha moved and Simacek seconded the motion to accept the quote from Beaver Creek Antiques and Restoration to stain and resurface the exterior doors on the east, west, and north entrances to the courthouse for an amount not to exceed $550.00.  Upon roll call, the vote was as follows:

 

Ayes: Mueller, Cerny, Simacek, Capek, Yates, Galusha, and Kimbrough

Nays: None

 

            The Chairman declared the motion carried.

 

 

SALARY CLAIMS APPROVED

 

            Mueller moved and Galusha seconded the motion to approve the salary claims as presented.  Upon roll call, the vote was as follows:

 

Ayes: Cerny, Simacek, Capek, Yates, Galusha, Kimbrough, and Mueller

Nays: None

 

            The Chairman declared the motion carried.

 

REPORTS

 

            The minutes of the last meeting of the Fillmore County Visitors Committee were reviewed and ordered placed on file in the Clerk’s office.

 

FEE REPORTS

 

            Capek moved and Yates seconded the motion to approve the following fee reports for the month of May:

 

            Sheriff -  $1,784.63      Clerk of District Court - $135.00                     Clerk - $6,661.53

 

Upon roll call, the vote was as follows:

 

Ayes: Simacek, Capek, Yates, Galusha, Kimbrough, Mueller, and Cerny

Nays: None

 

            The Chairman declared the motion carried.

 

BOARD OF EQUALIZATION

 

            Mueller moved and Capek seconded the motion to go into session as the Fillmore County Board of Equalization at 9.19 a.m.  Upon roll call, the vote was as follows:

 

Ayes: Capek, Yates, Galusha, Kimbrough, Mueller, Cerny, and Simacek

Nays: None

 

            The Chairman declared the motion carried.

 

APPLICATION FOR EXEMPTION FROM MOTOR VEHICLE FEES

 

            The County Treasurer presented an application from the Sisters of St. Francis for exemption from motor vehicle fees. 

 

Cerny moved and Galusha seconded the motion to approve the application of the Sisters of St. Francis for exemption from motor vehicle fees on a 1998 Ford.  Upon roll call, the vote was as follows:

 

Ayes: Yates, Galusha, Kimbrough, Mueller, Cerny, Simacek, and Capek

Nays: None

 

            The Chairman declared the motion carried.

 

VALUATION CHANGES

 

            Mueller moved and Capek seconded the motion to approve valuation changes due to clerical changes or late reporting on parcel numbers 8110, 3716, and 9658.  Upon roll call, the vote was as follows:

 

Ayes: Galusha, Kimbrough, Mueller, Cerny, Simacek, Capek, and Yates

Nays: None

 

            The Chairman declared the motion carried.

 

ADDITIONAL PARCELS

 

The Assessor presented a list of parcels that were figured in the CAMA program but not completed by the May 25th meeting and therefore not listed when the changes were approved, said list as follows:

RETURN TO REGULAR SESSION

 

Yates moved and Mueller seconded the motion to adjourn the Fillmore County Board of Equalization and return to regular session of the County Board at 9.32 a.m. Upon roll call, the vote was as follows:

 

Ayes: Kimbrough, Mueller, Cerny, Simacek, Capek, Yates, and Galusha

Nays: None

 

            The Chairman declared the motion carried.

 

DRIVEWAY PERMIT

 

            Capek moved and Galusha seconded the motion to approve the application of TMT Swartzendruber for a permit to install a new driveway in the NW ¼ SW ¼ of Sec. 20-5-3, Hamilton Township, just south of the cattle lot.  Upon roll call, the vote was as follows:

 

Ayes: Mueller, Cerny, Simacek, Capek, Yates, Galusha, and Kimbrough

Nays: None

 

            The Chairman declared the motion carried.

 

UNDERGROUND UTILITY LINE

 

            Yates moved and Galusha seconded the motion to approve the application of Alltel Communications for permission to install buried communications cable in or across county right-of-way at the following locations:

 

            between Sec. 16 and 21-6-1, Glengary Township, and

            between Sec. 29 and 30-7-4, Bennett Township,

 

and that said Alltel Communications shall assume all liability for the construction, maintenance, and repair of said    underground communications cable. Upon roll call, the vote was as follows:

 

Ayes: Cerny, Simacek, Capek, Yates, Galusha, and Kimbrough

Nays: Mueller

 

            The Chairman declared the motion carried.

 

CLEANING DRAINAGE IN SW ¼ SEC.  21-5-1, FRANKLIN

 

            The landowner of the SW ¼ of Sec. 21-5-1, Franklin Township, has asked if the county would clean out a draw or creek channel through the southwest corner of his property at his expense.  The silted channel does not affect county roads adjacent to the property.

 

            Galusha moved and Capek seconded the motion to decline to do channel cleaning on private property when the channel involved does not affect adjacent county roads.  Upon roll call, the vote was as follows:

 

Ayes: Simacek, Capek, Yates, Galusha, Kimbrough, Mueller, and Cerny

Nays: None

 

            The Chairman declared the motion carried.

 

SALARY COMMITTEE

 

            Salary Committee Chairman Capek reported that the committee recommends a salary increase of between 2 and 2.5 per cent or an increase of 20 to 25 cents per hour based on a $10.00 per hour rate.  Elected officials are not included because their salaries are set before the term of office begins.

 

SALARY INCREASE

 

            After discussion, Capek moved and Mueller seconded the motion to approve a pay increase of 25 cents per hour for all employees except the Deputy Civil Defense Director and elected officials, effective July 1, 2004.

 

Upon roll call, the vote was as follows:

 

Ayes: Capek, Yates, Galusha, and Mueller

Nays: Kimbrough, Cerny, and Simacek

 

            The Chairman declared the motion carried.

 

SOUTHEAST NEBRASKA DEVELOPMENT DISTRICT

 

George Frey, Executive Director of the Southeast Nebraska Development District, met with the Board to discuss services that would be available to the county by joining the District and to answer questions they might have.

 

PLANNING AND ZONING

 

The Planning and Zoning Director advised the Board that the Fillmore Western Railway has requested that the subdivision requirement be waived for the repurchase of certain tracts of land previously sold by them between Fairmont and Geneva.  After discussion, the Board took no action, allowing the subdivision requirement to stand.

 

EMERGENCY MANAGEMENT

 

Emergency Management Coordinator Marshall and Sheriff Burgess approached the Board about the possible purchase of a 30-foot travel trailer for use as a mobile communications/command center in case of disaster.  Consensus of the Board was that it should be deferred until later. 

 

The Emergency Management Coordinator reported that Perennial Public Power was the only public entity that suffered enough storm damage to possibly qualify for Federal grant money for repairs.  Two private homes had considerable damage and a number of pivots and some grain bins were damaged in the storms at the end of May.
